Back Pay Calculator For App Drivers
Uber-Lyft-Via-Juno drivers can use NYTWA’s Back Pay Calculator to add up how much the Department of Labor (DOL) owes you in back weeks of benefits. Because of a legal victory in a case filed by NYTWA and our members, a federal judge has ordered the DOL to process App drivers’ unemployment applications as employee claims, meaning based on your gross income, and not as independent contractors whose rate is based on net income. We created this calculator to help drivers estimate the amount of back pay benefits they are owed. We want to make sure that all eligible drivers receive their full benefits! If you already received back pay, you can still use this calculator to make sure you were paid the correct amount. If you have an adjusted rate but are still waiting for back pay, you can use this calculator to see how much you should be receiving. We will be in touch with you about how to make sure that you get the full amount of backpay you are entitled to.

How To Use the Back Pay Calculator
Old Weekly Benefit Rate: this is the benefit rate that you received before filing a Request for Reconsideration. For most drivers, this rate is $182. Make sure to check your payment history and enter the correct amount
Total Effective Days Under Older Rate: In your payment history, add the total number of effective days when you were being paid the lower benefit rate. The number of effective days may be different for each week if you went back to work. For example, if you did not work at all in a particular week, your effective days will be 4, if you worked one day, your effective day will be 3 and so on. After identifying all of the weeks that you were paid the lower rate, add up the total number of effective days and enter the total in this field.
Adjusted Weekly Benefit Rate: This is your new weekly benefit rate that the DOL issued after processing your Request for Reconsideration. For most full time drivers this will be $504
Missing Back Pay: This is the estimated total that amount of back pay that is owed to you.
